EPA issued Engineering Aggregates' Plant 1 a Notice of Violation (NOV) on September 23, 2015 alleging a violation of the Indiana SIP. The alleged violation occurred on July 22, 2015 when EPA inspectors conducted off-site surveillance and observed fugitive particulate matter from Plant 1 crossing beyond Plant 1's boundary line or property line.
This CAFO requires Engineering Aggregates to pay a civil penalty of $6,000. This CAFO will be issued concurrently with an Administrative Consent Order seeking injunctive relief appropriate and necessary to bring the facility into compliance with the Indiana SIP.
