Summary

On April 27, 2016, Region 10 issued an administrative order on consent to Timberland Bank in Ocean Shores, Washington, to address Clean Water Act violations. The order is to remedy the environmental and habitat losses resulting from the discharge of an unspecified quantity of dredged and/or fill material by former owners of the real properties in Ocean Shores, Washington. Timberland Bank agrees to voluntarily undertake all requirements of the order upon its foreclosure and taking title to the real properties. Timberland Bank will submit a Fill Removal and Restoration Work Plan for 0.45 acres of wetlands on the properties to the EPA for review and approval. Timberland Bank is required to implement the EPA-approved plan and complete specified tasks within one year of taking title to the properties. This order replaces and supersedes the Compliance Order, CWA-10-2010-0244, issued to the former owners of the properties, Ralph Burgess and John Kilcup, on September 15, 2010.
