On March 24, 2016, Region 10 issued a compliance order on consent resolving violations of the Clean Water Act by Warm Springs Forest Products Industries in Warm Springs, Oregon. This facility is tribally owned (Confederated Tribes of Warm Springs Reservation of Oregon). Respondent, which operates a logging facility, allowed its permit to expire and is effectively discharging pollutants to the waters of U.S. without a permit. The respondent agreed to comply with the terms of the expired permit until a new permit is issued. The respondent was operating in compliance with the terms of the expired permit and the new permit condition is likely to be very similar.
