EPA and Respondent settled this case with a CAFO under CERCLA - Section 103, failure to notify in emergency and EPCRA 311/312, in that Respondent failed to immediately notify NRC of the release on June 17, 2014, failed to submit MSDS for diesel fuel, failed to submit to the LEPC an MSDS for diesel fuel, failed to submit MSDS for diesel fuel to Bloomfield Township Fire Dept., failed to submit to SERC, LEPC and local Fire Dept. a completed Emergency and Hazardous Chemical Inventory Form including diesel fuel for Calendar Year 2011, or Calendar Year 2012 or Calendar Year 2013 and for Calendar Year 2014. Respondent had also not submitted a completed Hazardous Chemical Inventory Form to the Bloomfield Township Fire Dept. for calendar year 2013. The penalty for the CERCLA violation was $14,633.01 and for the EPCRA violations was $65,696.46.
