On February 19, 2016, EPA negotiated an Administrative Order on Consent (Order) with the City of Middletown, Connecticut pursuant to Sections 308 and 309 of the Clean Water Act. The Order addresses unauthorized discharges of untreated sewage from the City?s sanitary sewer collection system to the Coginchaug River, Sumner Brook, Miner Brook, and the Connecticut River. The Order requires that, in order to provide for proper operation and management of its collection system and to prevent future sanitary sewer overflows, the City develop and implement a Capacity, Management, Operations, and Maintenance (CMOM) program and submit documentation of its program to EPA and the Connecticut Department of Energy and Environmental Protection.
