The Respondent operates a dry dock facility located at the Brooklyn Navy Yard in Brooklyn, New York. The facility failed to comply with various conditions of its NYSDEC SPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity, including failure to develop, update and implement the SWPPP, failure to conduct and document Quarterly Visual Monitoring and Dry Weather Flow Inspections, failure to maintain records, non-stormwater discharges, etc. Stormwater and non-stormwater discharges from the site flow into the East River via outfall pipes. This CA/FO includes a $27,000 cash penalty and a $67,101.38 SEP. The SEP includes the permanent conversion of a diesel powered crane to an electric fuel source and utilizing bio diesel fuel on-site for equipment.
