On September 12, 2012, EPA conducted an inspection of the City's sanitary sewer system and identified documented instances where sanitary sewer system overflows resulted in discharges of sanitary sewage to waterbodies of the United States via the MS4. The City owns and operates a permitted MS4 in Mount Vernon, NY. MS4 Inspections were conducted by EPA on April 9 and 10, 2013 and dry weather sampling was conducted on September 9 and 10, 2013. EPA identified that the City was not in compliance with the NYSDEC SPDES MS4 General Permit regarding IDDE. This Administrative Order is being issued to include a revised compliance schedule from the previously issued Order CWA-02-2014-3023. The City is in the process of implementing the developed MS4 and SSS Plans to address illicit connections to the MS4 as required by the MS4 Permit and a CMOM to eliminate unpermitted discharges of sanitary sewage.
