The Regional Judicial Officer issued a Final Order on March 16, 2016, ratifying a Consent Agreement with Ateeco, Inc. d/b/a Mrs.T's Pierogies, to simultaneously commence and settle an enforcement action for violations of CAA Section 112(r)(1) and (7) in connection with the use and storage of anhydrous ammonia and propane at the Mrs. T's Pierogies facility in Shenandoah, Schuylkill County, Pennsylvania (Facility). Ateeco manufactures pierogies at the Facility, which uses anhydrous ammonia in a refrigeration system for cooling. The Facility also uses propane to provide fuel for heating water to produce steam to cook its product. Ateeco failed to ensure that the Facility's refrigeration system's compressor room and propane storage tank were designed and installed to provide protections consistent with industry safety standards for ammonia refrigeration systems and propane, accordingly. On April 2, 2015, Ateeco entered into an Administrative Settlement Agreement and Order on Consent with EPA to address the alleged violations with facility improvements; the company submitted its completion report for the work on February 15, 2016, which EPA approved on February 24, 2016. In settlement, Ateeco, Inc. has agreed to pay a penalty of $52,087.
