In March 2016, Region 10 filed an ESA against Gordon Trucking, Inc. in Pacific, Washington. The ESA was for $5,000. The facility qualified for ESA instead of the traditional enforcement policy because they had less than 300,000 pounds of diesel stored on-site and were not storing extremely hazardous chemicals. The ESA resolves violations of the hazardous substances inventory reporting requirements of the Emergency Planning and Community Right-to-Know Act.
