On July 13, 2016, EPA Region 1 filed a consent agreement and final order resolving violations of the requirements of the Renovation, Repair and Painting Rule, promulgated pursuant to Section 402(c)(3) of the Residential Lead-Based Paint Hazard Reduction Act of 1992. St. Laurent Construction Co. Inc. is a construction company that builds and renovates properties in New Hampshire. EPA alleged five violations pertaining to two renovation projects performed in 2014 in Merrimack and Nashua, New Hampshire. The alleged violations included failing to: obtain initial firm certification from EPA; provide the owner of the property with the EPA pamphlet entitled ?Renovate Right?; and, retain records demonstrating compliance with the RRP Rule. Following the inspection, the company has come into compliance with the Renovation, Repair, and Painting Rule. St. Laurent Construction has agreed to pay a penalty of $7,966 to resolve the violations. This settlement is expected to encourage compliance in the regulated community with the Renovation, Repair and Painting Rule and help protect residents from exposure to lead-based paint.
Specifically, EPA alleges that St. Laurent violated the requirements of the RRP Rule in 2014 by failing to: (1) obtain initial firm certification from EPA (40 C.F.R ? 745.81(a)(2)(ii));
(2) provide the owner of the property with the EPA pamphlet entitled ?Renovate Right? (40 C.F.R. ? 745.84(a)(1)); and, (3) retain records (40 C.F.R. ? 745.86(a)).
