The Regional Judicial Officer issued a Final Order on March 30, 2016, ratifying the Consent Agreement to commence and settle violations of EPCRA Section 312 and the CAA Section 112(r)(1), in connection with the storage of chemicals at a chemical distribution facility owned and operated by Blue Ridge Solvents and Coatings, Inc., and located at 3800 Original Henry Road in Henry, Virginia. Blue Ridge Solvents and Coatings failed to timely submit emergency and hazardous chemical inventory forms (Tier 2s) to the state, county, and local reporting entities for twenty hazardous chemicals it was storing on-site from 2012 to 2014. In addition, Blue Ridge failed to ensure adequate ventilation for a storage room containing 150-pound cylinders of chlorine, a toxic extremely hazardous substance. In settlement, Blue Ridge Solvents and Coatings has agreed to pay a cash penalty of $21,391.
