On September 4, 1987, the Defendant, which is the former insurer of owner/operator (LCP Chemicals, Inc.) of the LCP Chemicals, Inc. Superfund Site in Linden, NJ, entered into receivership in Illinois state court . EPA has claims against the Defendant under the excess umbrella policy issued to LCP in connection with LCP's liability at multiple sites across EPA Regions 2, 3, and 4. The United States entered into a Settlement Agreement with the statutory and court-affirmed Rehabilitator of the Defendant to settle EPA's claims in the total amount of $8,750,000. The Illinois state court approved the settlement on July 12, 2017.
