On October 23, 2012 Respondent's facility released approximately 896 pounds of ammonia. Respondent did not notify the NRC until October 24, 2012. Respondent did not provide the required written follow-up notification to the SERC. A civil penalty in this CAFO was agreed upon of $4,318 for the CERCLA violation, and a civil penalty of $4,318 was agreed upon for the EPCRA penalty. Payment of both penalties was made. In addition, Respondent must complete a Supplemental Environmental Project (SEP) designed to protect the public health by providing first responders with response equipment and spend at least $33,015.94 as follows: a0 Blue Earth $6,537.63; b) Easton Fire Department $6,570, c) Granada Fire Department $6,594.81; d) Bricelyn Fire Dept. $6,540 and e) Clarks Grove Fire Department $6,773.50.
