Summary

On 03/01/2019, the Department of Justice (DOJ) filed a Joint Stipulation of Settlement and Judgment with the Oregon District Court resolving violations of Sections 301(a) and 311(b) of the CWA by Union Pacific Railroad Company. The court entered judgment on 03/26/2019. EPA alleged that on September 12, 2014, a locomotive owned and operated by the Defendant collided with a derail device in Salem, Oregon, resulting in a discharge of 36 barrels of diesel fuel, some of which reached Pringle Creek, in violation of the Clean Water Act. The company performed cleanup of this spill and agreed to pay a $47,500 penalty to EPA. The company also agreed to pay a $47,500 penalty to the State of Oregon.
