On May 2, 2016, Region 1 filed a consent agreement and final order resolving Clean Water Act (CWA) violations. Region 1 had filed an administrative complaint against the Whipple Construction Company for CWA violations associated with construction of two residences in Ashburnham, Massachusetts. The Complaint alleged that Whipple Construction had discharged stormwater from the construction site without having applied for permit coverage under the Construction General Permit. The company has agreed to pay a $6,125 penalty to resolve this matter. The Region has worked in close coordination with the Ashburnham Conservation Commission throughout this matter.
