## Summary

On April 25, 2016, EPA filed a Consent Agreement and Final Order, which initiated and settled EPA?s penalty claim against Purvis Brothers, Inc. (Purvis), the owner and operator of an oil storage facility located in Mars, Pennsylvania (the Facility). The Consent Agreement asserts that Purvis violated the CWA, and its implementing regulations by its failure to: properly prepare and fully implement a written SPCC Plan that meets all the requirements under Part 112; have a licensed professional engineer certify three of five attestations; describe the physical layout of the facility and include a facility diagram marking the location and contents or capacity of each oil storage container at the Facility; provide appropriate secondary containment; maintain records pertaining to drainage of rainwater from the Facility; regularly inspect, test, and record inspections of aboveground containers for integrity and have personnel with appropriate qualifications perform such tests and inspections; to regularly inspect aboveground pipes; and to properly design pipe supports to minimize abrasion and corrosion and allow for expansion and contraction.  Public notice and opportunity to comment was provided prior to entry of settlement. No comments were received.  Respondent has agreed to pay a penalty of $46,769 to settle the matter.
