on April 26, 2016, Region III filed a CAFO simultaneously initiating and resolving a civil penalty action against Williams Ohio Valley Midstream, LLC (Respondent).  The basis of the CAFO is Respondent?s failure to comply with the CAA, the CAA?s Title V Operating Permit program, a state operating permit issued pursuant to the West Virginia State Implementation Plan (the VA SIP), and provisions of the New Source Performance Standard (NSPS) for equipment leaks of VOCs from onshore natural gas processing plants, 40 C.F.R. Part 60, Subpart KKK at Respondent?s Fort Beeler natural gas processing plant located on Route 250 Cameron, WV (the Facility). 

The specific provisions alleged to have been violated include: failure to include information required by 45 W. Va. C.S.R. ? 13-5.4 in WVSIP operating permit applications; failure to create and maintain records of fuel use for each compressor engine; failure to conduct visible emissions checks and/or opacity monitoring and failure to retain or have available the required records of such checks and monitoring; failure to retain or have available the required records of fuel use; failure to monitor the presence or absence of a flare pilot flame to ensure that the Facility?s flare is operated with a flame present at all times whenever emissions may be vented; failure to timely apply for a Title V operating permit; failure to equip open ended lines with the required cap, blind flange, plug, or a second valve; failure to monitor valves in
