On April 22, 2016, the Region entered into a Clean Water Act Order on Consent with a metal finishing operation, Invensys Systems, Inc. (Invensys), in Foxboro, Massachusetts. On July 17, 2015, EPA issued an NPDES permit to Invensys which superseded the previously-issued permit. The reissued permit contains effluent limitations for copper, lead, cadmium, zinc, aluminum, tetrachloroethylene, trichloroethylene and whole effluent toxicity, among other things. On September 4, 2015, Invensys Systems filed a petition for review with the Environmental Appeals Board and the permit was stayed in its entirety. Negotiations between EPA and Invensys resulted in an agreement that the petition for review would be withdrawn and EPA would issue this Administrative Consent Order allowing for a reasonable time frame for achieving compliance with the permit conditions.
