The Respondent and his spouse own the property, upon which the Battery Recycling Company's (BRC) former battery processing facility is located. BRC is the owner and operator of former battery processing facility at the Site. The Order requires Respondents to: (a) provide EPA unrestricted access for the purpose of conducting response activities at the facility, (b) refrain from removing contaminated or potentially contaminated assets or equipment from the facility without EPA approval and oversight, and (c) refrain from taking actions that may result in the release of hazardous substances or interfere with EPA's access to, investigation of, or other response activities at, the Facility.
