Region 3 filed an Expedited Settlement Agreement which settled EPA's penalty claim for violations of CWA Section 311 (j) at the Berks Products Corporation facility located in Reading, Pennsylvania. The facility failed to ensure the SPCC plan certification contained the required elements, failed to ensure management approval of the SPCC plan, failed to have an adequate facility diagram, and failed to have a complete listing of all oil storage containers at the facility. The respondent has agreed to pay a cash penalty of $675 to settle the matter.
