The settling parties are Green Crow Corporation (Green Crow), owner of property overlying underground mine tunnels, and Dwight Hill Forest, LLC (Dwight Hill), a newly-created entity that will take title to the property currently owned by Ely Mine Forest, Inc. (EMFI). The proposed Settlement Agreement requires: (1) transfer of the EMFI property to Dwight Hill; (2) provision of access and imposition of institutional controls on a site-wide basis; (3) provision to EPA of a convenient source of borrow material, thereby saving EPA the cost of purchasing clean fill; and (4) maintenance and monitoring activities on the EMFI property.
