On June 27, 2016, EPA issued a Consent Agreement and Final Order to March Mountain Properties, LLC, 1005 Heathercroft Circle, Crozet, Virginia (Respondent) in settlement of violations under Section 301 of the CWA and Respondent's General Permit No. VAR10, General Permit for Stormwater Discharges Associated with Construction Activity. The alleged violations include: failing to update the Stormwater Pollution Prevention Plan, failing to implement controls to minimize pollution, and failing to properly document inspections, among other things. In addition, EPA issued an Administrative Order on Consent, requiring the Respondent to take all actions to comply with the effective Virginia General Permit for Stormwater Discharges Associated with Industrial Activity. The CAFO settles the matter for a penalty in the amount of $66,000. The Respondent must come into compliance with the VPDES within thirty days of the effective date of the AOC.
