The Administrative Consent Order (ACO) for Utica East Ohio Midstream LLC, Kensington, Ohio addresses violations regarding the Standards of Performance for Crude Oil and Natural Gas Production, Transmission and Distribution at 40 C.F.R. Part 60, Subpart OOOO.
Specifically, UEO failed to timely identify, monitor and detect repair leaks from certain valves, connectors, and pumps; failed to cap, plug, blind flange, or second-valve certain open ended valves or lines; failed to monitor new pumps and valves on a timely basis, and failed to capture and control tank emissions as required in Subpart OOOO. UEO has also agreed to the terms of a Consent Agreement and Final Order that will be entered contemporaneously with the Administrative Consent Order, and will require UEO to pay a civil penalty of $175,000.
This ACO requires Utica East Ohio Midstream LLC to implement a compliance program within three months that includes a leak detection and repair audit program with monitoring, tracking and corrective action provisions, as well as include non-regulated equipment on tanks into their Leak Detection and Repair Program.
