On July 19, 2016, EPA issued a Consent Agreement and Final Order (CAFO) to Pumpco to resolve RCRA violations. The violations were discovered during the period of May 2015 through November 2015 when EPA conducted an investigation and record review of Pumpco?s performance as a hazardous waste generator. EPA discovered that Pumpco, operating five (5) facilities in Texas from 2011 to 2014, generated and offered for transport and disposal hazardous waste that exceeded the threshold amount of 100 kg and in some instances 1,000 kg of hazardous waste per month which qualifies Pumpco as a small quantity generator and in others a large quantity generator. During that period, Pumpco was registered as a conditionally exempt small quantity generator, violating the requirement to provide notification under RCRA ? 3010(a), 42 U.S.C. ? 6930(a) and the operational requirements of a generator under RCRA. The facility is ordered to pay a penalty of $237,980.00
