On July 21, 2016, Region 2 issued a CERCLA Administrative Order on Consent for Remedial Design relating to the Lower Ley Creek Operable Unit (OU) of the Onondaga Lake Superfund Site in New York State. Under the terms of the Order, seven potentially responsible parties are jointly and severally obligated to prepare the remedial design of the remedy selected in the 2014 Record of Decision for this OU. In addition, the Order requires the PRPs to reimburse EPA's future response costs incurred in connection with the oversight of the remedial design activities. The Order memorializes the understanding that the PRPs may seek access to certain funds in a CERCLA special account for the OU after EPA's past costs are reimbursed and conditioned upon one or more of the PRPs executing a future consent decree for the implementation of the remedy that is being designed under the Order.
