Respondent was charged with 3 violations of TSCA: (1) shipping 2 drums of PCB waste without identifying it as PCB on the manifest, (2) using 1 PCB Transformer without preparing complete records of quarterly visual inspections, and (3) improper storage of bulk remediation waste soil. The waste oil was eventually identified and properly disposed, the PCB Transformer in now being inspected monthly with proper records kept, and the remediation soil is being disposed at a TSCA disposal facility. Respondent was charged a $50,500 penalty.
