From October 2015 to March 2016 EPA conducted investigation on Nustar Logistics, L.P. During investigation EPA found three Facilities, Edinburg Facility, Harlingen Facility and Laredo Facility, all of which were calling themselves CESQG's was operating as LQG's. CAFO was issued to the Facility with regards to the following violations:
1. Edinburg Facility: TCEQ took action before EPA for generator classification, EPA is Pursuing failure to adequately complete the manifest, EPA form 8700-22 , in violation with 40 CFR 262.20(a)(1).
2. Laredo Facility: EPA is pursuing Failure to File required notification of Hazardous waste activities for the Laredo Facility in violation of Section 3010(a) of RCRA, 42 U.S.C. ? 6930(a) and Failure to operate within proper generator status , in violation with 40 C.F.R. Parts 124, 262-68, 270.
3. Harlingen Facility: EPA is pursuing Failure to File required notification of Hazardous waste activities for the Harlingen Facility in violation of Section 3010(a) of RCRA, 42 U.S.C. ? 6930(a) and Failure to operate within proper generator status , in violation with 40 C.F.R. Parts 124, 262-68, 270
The CAFO requires Nustar Logistics LP to pay a civil penalty of $56,658 and certify to their return to compliance.
