On July 15, 2016, EPA Region 2 issued a Complaint, Compliance Order and Notice of Opportunity for Hearing to the Respondents, for violations found at the facility located at 455 First Avenue, New York, New York. The Complaint alleged the following two violations: the failure to make hazardous waste determinations and the failure to have a hazardous waste permit for the storage of hazardous waste. The Complaint, issued pursuant to Section 3008 of RCRA, includes a proposed penalty of $49,178 and orders compliance with the aforementioned RCRA requirements. In the settlement, the New York City Department of Health and Mental Hygiene agreed to pay a civil penalty of $43,000 and comply with New York's authorized hazardous waste regulations.
