## Summary

EPA is issuing an Administrative Consent Order (ACO) and a Consent Agreement and Final Order (CAFO) commencing and concluding an action against Ethanol 2000, LLP d/b/a POET Biorefining - Bingham Lake (POET) for alleged violations of the Clean Air Act.  POET operates an ethanol production facility in Bingham Lake, Minnesota.  EPA alleged that, from August 2013 through May 2015, the facility operated fermentation and distillation units during scrubber downtime, in violation of their operating permit and that, from January 2011 through May 2015, POET failed to operate the scrubbers as required by its permits, and failed to take and record corrective action upon discovering deviations.
The ACO requires POET to modify the facility such that, during scrubber downtime, emissions from the fermentation system are controlled by an existing thermal oxidizer. The CAFO requires POET to pay a civil penalty of $110,000.
