## Summary

Through this Consent Agreement and Final Order (CAFO), EPA and United Scrap Metal agree to commence and conclude simultaneously the following violations:

-United failed to comply with the requirements of the Illinois SIP at 35 Ill. Adm. Code 212.301.  Specifically, On May 22, 2014, emissions of visible fugitive particulate matter originated from the facility's torching operation and traveled beyond its property line.

-United failed to comply with the regulations at 40 C.F.R. 82.156. Specifically, on May 22, 2014, United Scrap failed to supply EPA with verification that included a signed statement from the person(s) from whom the four room air conditioner units were obtained that all refrigerant that had not leaked previously has been recovered from the appliances

Following a post NOV/FOV meeting with EPA, United submitted documents to EPA verifying that it has undertaken steps to return to compliance with the applicable requirements cited in the NOV/FOV. The documents included a revision to the facility's fugitive dust plan and a revision to its scrap inspection procedures. After multiple settlement calls and meetings, EPA and United Scrap agreed to settle the case for a payment of $8,750 penalty and a supplemental environmental project (SEP) worth $33,000.

As part of the SEP, United Scrap Metal will replace an existing 1979 Bryan model F-900 boiler having a 1,000,000 BTU input, with two (2) new Apex model APX525 boilers, each with a 500,000 BTU input. The boiler
