Summary

On March 31, 2014, EPA issued a Finding of Violation (FOV) to Carmeuse Lime, Millersville, Ohio for violations of the National Emission Standards for Lime Manufacturing Plants, at 40 C.F.R. Part 63, Subpart AAAAA (Lime Manufacturing MACT) and the facility's Title 5 permit. The FOV alleged violations of the particulate matter emission standard of the Lime Manufacturing MACT. The violations were discovered through a Section 114 request requiring stack testing. A Section 113 conference was held on June 23, 2014. This Administrative Consent Order (ACO) will be issued simultaneously with a Consent Agreement and Final Order (CAFO) to resolve the violations. The ACO requires Carmeuse Lime to make physical improvements to its scrubbers controlling Kilns 1 and 2. It also establishes operational limits and requires performance testing, maintenance, permitting, record keeping and reporting to ensure Carmeuse Lime?s return to and continuous compliance with the Lime Manufacturing MACT. The emission reductions due to upgrading the scrubbers is about 52 tons per year of PM. The CAFO requires the payment of a $140,000 penalty.
