In August of 2014, Respondent was a subcontractor and added 7,165 cubic yards of rock, sand, and dirt from bulldozers and backhoes into 1.11 acres of wetlands to build a baseball diamond at the Lexington Athletic Complex in Blaine, Minnesota, without a U.S. Army Corps of Engineers Section 404(b) Dredge and Fill Permit, 33 U.S.C. ? 1344, and in violation of section 301 of the Act, 33 U.S.C. ? 1311. The CAFO is an agreement to pay $1000.
