On September 22, 2016, Region 10 issued an administrative order on consent with Joseph O'Meara, Joseph O'Meara Living Trust, and Killarney West Golf Course, Inc. (Respondents) to resolve Clean Water Act (CWA) violations in Hillsboro, Oregon. Respondents violated the CWA by discharging an unspecified quantity of dredged and/or fill material into waters of the United States without authorization under Section 404 of the Act. The discharge filled below the ordinary high water mark of a 3,960 foot section of the bed and bank of Dairy Creek and along a 739 foot section of Council Creek. Respondents agreed to restore valuable habitat used by Upper Willamette steelhead trout and other aquatic species through an EPA-approved Fill Removal and Restoration Plan.
