EPA and its contractors, including an ammonia refrigeration expert, found numerous dangerous conditions associated with Stavis?s handling of anhydrous ammonia at its seafood processing facility in Boston, Massachusetts. Accordingly, EPA finds that Stavis violated Section 112(r)(1) of the Clean Air Act (?CAA?), 42 U.S.C. ? 7412(r)(1), by failing to comply with the General Duty Clause (?GDC?) for its use, storage, and handling of anhydrous ammonia, an extremely hazardous substance, at the facility. Stavis is no longer operating the ammonia refrigeration system at the Facility and has removed most of the ammonia following a major release. However, some ammonia remains in the system. The NOV/AO requires Stavis to prepare and submit a plan for safely removing the remaining ammonia in the system, and bars the company from adding ammonia back to the system without first submitting a plan for addressing the dangerous conditions identified by EPA.
