On August 29, 2016, EPA Region 6 issued an Administrative Order of Consent (AOC) under its authority pursuant to section 112(r) of the Clean Air Act (CAA) to United States Cold Storage, LP located in Fort Worth, Texas. The AOC was issued in response to violation of the general duty clause in section 112(r)(1) of the CAA. The AOC requires United States Cold Storage, LP to comply with the general duties to identify hazards, design and maintain a safe facility so as to prevent releases, and mitigate releases that do occur as follows: within 30 days of the effective date of this order, United States Cold Storage, LP shall certify that it has evaluated all of the hydrostatic relief valves in operation at the Facility to ensure that they are set at a pressure differential appropriate for safe facility operation.
