On September 27, 2016, EPA filed a Consent Agreement and Final Order, which initiated and settled EPA 's penalty claim for violations of CERCLA I 03(a) and EPCRA Section 304, in connection with a release of approximately 35 pounds of chlorine that occurred on September 25, 2014 at Respondent's water treatment plant located at 7505
Gumboro Road, Pittsville, Maryland 21850. The Consent Agreement asserts that Respondent failed to immediately notify the National Response Center ( NRC ), the Local Emergency Planning Committee ( LEPC ), and the State Emergency Response Commission ( SERC ) as soon as Respondent knew or should have known that a release of a hazardous substance, namely chlorine, had occurred at the Facility in an amount equal to or exceeding the applicable RQ and that Respondent failed to provide a written follow-up emergency notice, as soon as practicable, to update the LEPC and the SERC regarding the September 25, 2014 release. Respondent has agreed to pay a penalty of $10,000 to settle the matter.
