On September 26, 2016, EPA Region 6 issued a Consent agreement and final order (CAFO) under its authority pursuant to Resource Conservation and Recovery Act to Oiltanking Port Neches Terminal located in Port Neches Texas. The CAFO was issued in response to violations the facility?s failure to file an adequate or accurate initial or subsequent notification, Section 3010 (a) of RCRA, 42 U.S.C 6930, and to meet the requirements of generator status per 40 CFR 262 and or 270. The CAFO requires Oiltanking Port Neches to notify its correct generator status, and to comply with the requirements of their generator status and to pay a penalty of $65,000.
