On December 15, 2016, the Regional Judicial Officer for Region III signed a Consent Agreement and Final Order ( CAFO ), which resolves allegations made in an Administrative Complaint and Notice of Opportunity ( Complaint ) for a Hearing issued on September 29, 2016. The Complaint alleges that the Respondent failed to prepare and implement a Spill Prevention, Control, and Countermeasures plan for its facility at 989 Pennsylvania A venue, Pen Argyl, Pennsylvania 18072, as required by 40 C.F.R.112.3. The settlement requires Respondent to pay a civil penalty of $23,000.00 for failure to prepare and implement an SPCC plan for at least 51 months.
