On February 4, 2021, following a comment period during which no comments were received, the court entered a consent decree which resolves the claims filed on behalf of the EPA, the Commonwealth of Pennsylvania and the State of West Virginia against Koppers Inc. The complaint in this matter, which had been filed concurrently with the lodging of the Consent Decree, alleged violations of the federal CWA SPCC and FRP regulations, as well as violations of Pennsylvania and West Virginia oil storage regulations at three Koppers Inc. facilities. The Koppers facilities are located in Clairton, Pennsylvania, Green Spring, West Virginia, and Follansbee, West Virginia. Under the consent decree, Koppers will pay to the United States, West Virginia, and Pennsylvania. The consent decree also contains limited injunctive relief with respect to the Follansbee facility; the Clairton and Green Spring facilities are now closed as part of a Koppers' plan to consolidate its operations.
