Summary

The Defendant, whose main corporate office is in Bayamon, Puerto Rico, owns and/or operates underground storage tanks (USTs) at many different locations on the island. The government's complaint alleged that the Defendant, at fifteen of its gas stations, violated UST requirements, including failures to: use proper spill and overfill prevention equipment; provide proper corrosion protection; test cathodic protection systems; monitor tanks or piping; secure monitoring wells; perform annual tests on leak detectors; properly equip line leak detectors; report and investigate suspected releases; and comply with financial assurance requirements. Under the settlement, the Defendant agreed to comply with the UST requirements it allegedly violated at the facilities cited in the complaint, and remedy specifically identified deficiencies. The company will also upgrade its operations at all forty three facilities where it owns and/or operates USTs by installing automatic tank gauging systems and centralized monitoring systems and pay a civil penalty of $125,000.
