## Summary

On May 25, 2017, the Regional Judicial Officer signed a Consent Agreement/Final Order (CA/FO) resolving violations of RCRA by the Respondent.  EPA alleged the Respondent failed to:  (a) make hazardous waste determinations for the waste-streams found at its Secaucus, New Jersey facility and (b) have a hazardous waste permit, or alternatively meet the conditions necessary to accumulate hazardous waste without having obtained a permit or qualifying for interim status. Some of the waste for which a determination had not been made was classified as acute hazardous waste. EPA also alleged the Respondent was not inspecting its hazardous waste storage area regularly and did not have required safety equipment such as a fire extinguishers, spill control equipment and communications equipment for that area. Not satisfying these safety conditions made the facility subject to hazardous waste permitting requirements.  Pursuant to the CAFO, the Respondent will pay a cash penalty of $30,980 dollars and is required to maintain compliance with  RCRA regulations.
