On September 29, 2016, EPA Region III entered a Consent Agreement and Final Order (�CAFO�) with Metallurgical Products Company (�MPC�) for violations of the Clean Air Act. MPC owns and operates a copper allow plant located at 810 Lincoln Avenue, West Chester PA, 19381. MPC failed to operate the facility�s two baghouses within the pressure drop operating range set forth in MPC�s State Only Operating Permit. EPA and MPC have agreed to resolve MPC�s liability for these violations through MPC operating the two baghouses according to the conditions of the permit and a cash penalty of $28,000.
Mettalurgical Products failed to operate the Facility within required CAA permit limits, which requires the Facility to maintain a pressure drop in between 1-8 in., w.g., for Baghouse #1 and 1-9 in., w.g., for Baghouse #2 of the Facility. Mettalurgical Products allowed the pressure drop to go above or below the permissible range on numerous occasions in the period from June 2011-March 2013.
