On September 30, 2016, Region 5 entered into an Expedited Settlement Agreement (ESA) and Final Order with Merrill Iron and Steel, Inc. (Merrill) of Schofield, Wisconsin commencing and concluding a matter under the Resource Conservation and Recovery Act (RCRA) for a settlement amount of $6,000. Merrill fabricates and paints plate and structural support steel for large industrial projects such as stadiums and office buildings. Merrill employs approximately 300 people at this facility. EPA alleged that Merrill had failed to identify in its contingency plan a list of emergency coordinators and an evacuation plan; failed to provide an annual review of hazardous waste management and contingency plan training; did not maintain certain personnel training documentation at the facility; failed to determine if certain waste generated or received was hazardous waste; failed to mark containers of used oil as such; and failed to close and label universal waste containers of lamps and waste batteries as required. Prior to entering into the ESA agreement, Merrill demonstrated to EPA that it was in compliance with RCRA and its implementing regulations.
