On December 20, 2016, the United States District Court, District of Connecticut, entered a Consent Decree between plaintiffs, the United States, on behalf of EPA, along with the State of Connecticut (State), and Eastgate Plaza, LLC (Eastgate). Eastgate is liable under CERCLA as an owner of property at the Scovill Industrial Landfill Superfund Site, located in Waterbury, Connecticut. Under the Consent Decree, Eastgate agrees to (1) pay EPA $93,000 and the State $7,000 within thirty days of entry of the Consent Decree, (2) provide access to Eastgate?s property, (3) implement an institutional control on Eastgate's property, and (4) accept a judgment lien in the amount of $13.7 million plus interest and any other unreimbursed response costs. The settlement amount is based upon Eastgate's documented inability to pay.
