On January 5, 2017, 2016, Region 10 filed an expedited settlement agreement and final order (ESA) with Circle K Stores, Inc., to address violations of the Underground Storage Tank (UST) rules at their facility in Kennewick, Washington. Respondent failed to provide corrosion protection to metal piping. Metal piping should be equipped with corrosion protection and tested every 3 years to prevent corrosion, which could potentially result in costly and harmful soil and groundwater contamination. Corrective actions taken under this settlement help prevent up to 22,000 gallons of gasoline (three lines) from potential release to the environment. Respondent provided documentation that the metal piping was no longer in contact with earthen material and agreed to pay a $2,550 penalty. This is the third UST ESA pilot settlement by Region 10 in FY17 using the ESA pilot authority to target repeat violators, while streamlining settlement for EPA and owners/operators.
