On December 6, 2016, Region 10 filed a consent agreement and final order resolving violations of the Safe Drinking Water Act by Hartley Motors, Inc. located in Palmer, Alaska. Region 10 alleged that Respondent, which operates a motor vehicle sales and service business, is in violation of the regulation protecting underground (groundwater) sources of drinking water from injection wells. Injection well activity can allow movement of fluid containing contaminants (such as wastewater from vehicle servicing) into underground sources of drinking water. Respondent failed to close its Motor Vehicle Waste Disposal Well by January 2005 as required. The facility is under a compliance schedule to close the well by June 30, 2017. Closure includes removal of all contaminated liquids, sludge and soil in and around the injection well. The company agreed to pay a penalty of $5600, which recovers the economic benefit the company received by delaying the well closure
