On June 9, 2015, and June 13, 2015, an inspector with the U.S. Environmental Protection Agency, conducted ?For Cause inspections at the Mission Lawn and Landscape (Mission) facility in Ronan, Montana. These inspections were conducted in response to an off target/drift complaint received on May 27, 2015, from participants and attendees at the adjacent baseball fields on the previous day.
Additionally the inspection revealed that Mission Lawn and Landscape had applied a restricted use pesticide (RUP) without first obtaining the required federal certification for RUP applications in Indian Country.
The evidence collected demonstrated that Mission Lawn and Landscape used registered pesticides in a manner inconsistent with their labeling. Using a registered pesticide in a manner inconsistent with its labeling is an unlawful act of FIFRA as noted in section 12(a)(2)(G), of FIFRA, 7 U.S.C. ? 136j(a)(2)(G).
A civil penalty for violating FIFRA ? 14(a)(2), 7 U.S.C. ? 136l(a)(2) was issued to Mission Lawn and Landscape.
