On November 1, 2016, Region 10 issued an administrative order on consent to the Hoonah Indian Association and the City of Hoonah (Respondents) to resolve Clean Water Act (CWA) violations in Hoonah, Alaska. Respondents violated the CWA by discharging approximately 4,950 cubic yards of boulder, rock, and gravel material into approximately 0.35 acres of intertidal areas of Port Frederick without a Department of the Army Corps of Engineers CWA Section 404 permit during rock blasting and earthmoving activities associated with their Hoonah Tunnel Bluffs Project. Respondents agreed to restore essential intertidal and subtidal habitat used by numerous marine species, including algae, crustaceans, and salmon through an EPA-approved Fill Removal Plan.
