On January 4, 2017, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act (CWA) by IKO Pacific, Inc. Respondent, which operates an asphalt shingle and coating material manufacturing facility in Sumas Washington, discharged pollutants to waters of the U.S. in violation of the Washington State NPDES Industrial Stormwater General Permit. Violations include failure to have a complete stormwater pollution prevention plan, failure to submit reports, and failure to conduct inspections. The company is now operating in compliance and will reduce stormwater discharges into Johnson Creek, which flows to the Sumas River, Fraser River and to the Pacific Ocean. These are anadromous fish passage waters. The company agreed to pay a penalty of $29,000.
