On December 15, 2016, Region 10 issued an administrative order on consent to the Martin Nygaard and Nygaard Land LLC (Respondents) to resolve Clean Water Act (CWA) violations in Warrenton, Oregon. Respondents violated the CWA by discharging an unspecified quantity of dredged and/or fill material into approximately 72.5 acres of freshwater wetlands and over 3,500 feet of jurisdictional tidal channels without a Department of the Army Corps of Engineers CWA Section 404 permit. Respondents agreed to restore essential wetland and tidal habitat used by salmon and other aquatic species through an EPA-approved Restoration Plan.
